1.What did Walmart do that is potentially wrong? Is it different than other local businesses
would do? Do you think it was wrong? Why or why not?
Walmart bribed local officials in Mexico to speed up the process of obtaining the permits,
licenses, and zoning approvals. This seemed to be a very well-orchestrated strategy to push its
expansion in Mexico. Also, they did not disclose any wrong-doing until the New York Times
article was published.
According to the Organized Crime and Corruption Reporting Project (OCCRP), more than 50%
of Mexican companies reported paying bribes to expedite business procedures. It seems that
corruption is rampant in Mexico and local companies expect to pay bribes to get things done.
From this perspective, Walmart was no different from any local company.
Bribing is certainly wrong and should not be resorted to by any company or an individual. This is
especially important for any American multi-national because of the extra-territorial powers of
the Foreign Corrupt Practices Act (FCPA). Even otherwise, bribing is ethically wrong because
the company is bribing to bend rules to gain market access and make a profit.

2.How did the organization of Walmart allow this to happen? What is the focus of Walmart?
Initially, Walmart conducted an internal investigation to understand if the allegations of
corruption were true. However, later on, they handed over the case to the chief counsel of its
Mexican subsidiary. The chief counsel – who was also a key suspect – then wrote a report
exonerating everyone in the case.
It seems to me that Walmart was focused on growth at any cost. Walmart’s top leadership chose
to look the other way and allowed the chief counsel to hush up the matter.
3.What, if any, penalty should Walmart suffer for their actions? What should they have done
differently?
Walmart should suffer exemplary punishment for this act. The people involved should go to jail.
Walmart should have come out in the open after they learned of the wrongdoing. Further, they
should have instituted internal controls to prevent anything like this in any part of their
organization.

4.How will this affect Walmart’s organization as a whole? How about their growth in other

As a result of this Walmart would have to improve its organizational governance and compliance
with the FCPA. This may slow down their growth in other countries. But it would save them
millions of dollars in fines and also improve their image.
